Parents or Guardians must review the Minor Child Waiver Release & Liability prior to registering their minor child (17 or under) for Goin’ Bald for Bucks.

 

Adult Waiver Release & Liability

As part of the Goin’ Bald For Bucks Program (the “Program”), participants will be choosing to participate in an event(s) of his or her choice (an “Event” or “Event(s)”, as applicable) and will be fundraising for the Roswell Park Alliance Foundation as part of each Event.  In consideration of my participation in the Program and the Event(s), including any programs and/or events associated with the Program and/or Event(s), I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE any of the following entities: the Roswell Park Alliance Foundation, including all subsidiaries, affiliates, and employees of the Roswell Park Alliance Foundation (collectively the “Alliance”); Roswell Park Cancer Institute, including all subsidiaries, affiliates, and employees of Roswell Park Cancer Institute (collectively “RPCI”); Health Research Inc., Roswell Park Division, including all subsidiaries, affiliates, and employees of Health Research Inc., Roswell Park Division (collectively “HRI”); the New York State Department of Health; the county and city/town where the Event(s) will take place; all police departments, fire departments, and/or emergency medical personnel that are involved in the Event(s); Event and Program affiliates, sponsors, and promoters; and/or all volunteers and other persons and entities associated with the Event(s) and/or the Program (collectively the “Indemnitees”) for any and all present and future claims, including those resulting from ordinary negligence, for any property damage, personal injury, death, and/or illness that I  might suffer during an Event.

I also waive any and all claims, including those resulting from ordinary negligence, that may be made by me and/or my heirs, executors, administrators, and/or other personal representatives and/or assigns, in connection with the Program and/or the Event(s).  I attest that I am physically fit, healthy, and cognitively able to participate in the Program and the Event(s) that I choose, and that I have not been advised otherwise by a qualified medical professional.  I understand that each child under the age of 18 who is participating in the Program must do so during each Event under the immediate and direct supervision of a parent, legal guardian, or, if the parents or legal guardians are unable to participate with the child, under the direct and immediate supervision of an adult designated by the parents or legal guardians in writing to the Alliance, who is also a registered participant in the applicable Event.  I also understand that if the parents or legal guardians are unable to participate with their child, that such child will not be permitted to participate in the applicable Event until an adult is designated as the child’s supervisor for the Event by the child’s parents or legal guardians in writing to the Alliance.

I understand that many potential hazards may exist in association with the Event that I choose, including accidents and/or injuries.  I am participating in the Event(s) with knowledge of all such risks, and I expressly agree and promise to accept and assume all of the risks associated with the Event(s).   I understand that my participation in each Event is purely voluntary.  As applicable to the Event, I agree to wear any required safety gear while participating in each Event.  I understand that I am solely responsible for my personal health, safety, and property at all times during each Event.

I agree to abide by all Program and Event rules, regulations, and instructions, and all applicable local, state, and federal laws.  I consent to receive medical treatment should an injury, accident, illness, and/or any other similar circumstance occur during any Event in which treatment is deemed necessary by a qualified medical professional.

If I observe any unusual hazard and/or physical ailment that may hinder my participation in any Event, I will remove myself from Event participation, and will notify Event representatives immediately.  I agree that Event representatives reserve the right to remove me from, or refuse my admission to, any Event if, in their sole discretion, they believe that continued participation presents a health and/or safety risk.

I understand that all donations made by me which are processed by the Alliance are non-refundable and non-transferable, even if I do not participate in the applicable Event.  I understand that, in order to participate in the Program, each Event participant who registers for an Event is required to raise a specified number of funds for the Program.  The fundraising thresholds for each individual Event will be contained on the Alliance’s online registration page for each Event.  I understand that, based on the specific Event chosen by me, there may be additional fundraising requirements mandated by the Event, and that my fundraising requirements for the Program are in addition to such Event-mandated fundraising requirements.  I understand that fundraising minimums for each Event are due no later than the day of such Event.

I grant full permissions to the Indemnitees to use the names, photographs, and videography of, and any quotations from, me in accounts of, and promotions, publicity, marketing, and/or advertising for, each Event and/or the Program.

I consent to receiving emails about the Program and each Event, including confirmation of my registration for each Event.

Should any Event and/or the Indemnitees and/or or anyone else acting on the applicable Event’s behalf be required to incur attorney’s fees and costs to enforce this Waive & Release of Liability, I agree to indemnify and hold them harmless for all such fees and costs.

I certify that I have adequate insurance to cover any injury and/or damage that I may cause and/or suffer while participating in the Event(s), or else I agree to bear the costs of such injury and/or damage.  I further certify that I am willing to assume the risk of any medical or physical condition that I may have.

I agree that if any portion of this Waive & Release of Liability is found to be void or unenforceable, that the remaining portions shall remain in full force and effect.

I have carefully read this Waiver & Release of Liability and fully understand its contents.  I am aware that by checking “Yes I agree”, or any variation therewith, online to this Waiver & Release of Liability, that I am certifying that I am at least 18 years of age or older, and that I am voluntarily agreeing to the terms of this Waiver & Release of Liability, including waiving certain legal rights of mine.  Knowing this, I agree to these terms, and to waive such rights, of my own free will.

I have carefully read this Waiver & Release of Liability, fully understand its contents, and have shared such information with my child.  I am aware that by checking “Yes I agree”, or any variation therewith, online to this Waiver & Release of Liability, that I am certifying that I am the child’s parent or legal guardian, that I am at least 18 years of age or older, and that I am, on behalf of my child, voluntarily agreeing to the terms of this Waiver & Release of Liability, including waiving certain legal rights of my child.   I hereby agree that I have my child’s full authority and consent to register him or her and enter into this Waiver & Release of Liability on his or her behalf.  I further acknowledge that I will deliver this Waiver & Release of Liability to my child before each Event.  In the event of any dispute and/or claim where my child denies my authority to sign on his or her behalf and/or otherwise disputes the enforceability of this Waiver & Release of Liability, I agree to defend, indemnify, and hold the Indemnitees harmless from and against any claims brought by my child.  Knowing this, I, on behalf of my child, agree to these terms, and to waive such rights, of my own free will.
